Terms of Service

These terms cover using the Gutter software ("Gutter"), buying Gutter Pro, and this website. Gutter is made by Kris Crowder ("we", "us"). By installing Gutter, buying Gutter Pro or using this site, you agree to these terms.

1. Using Gutter

You may install and use Gutter on computers you own or control, for yourself and the people in your household. Gutter is provided under the license included with it.

2. Your files

Gutter organizes and serves comic and manga files that you already have. We don't provide, host, sell or distribute any comics, and we never see your library. You are responsible for the files you use with Gutter and for having the right to keep and read them. Don't use Gutter to share copyrighted material with people who aren't allowed to have it.

3. Buying Gutter Pro

Gutter Pro is a one-time purchase that unlocks extra features on one Gutter server, for everyone who uses that server. Orders are processed by Stripe through Stripe Managed Payments, which acts as our reseller (merchant of record) for all orders and handles payment, sales tax and VAT, receipts and refunds. The reseller's own terms, shown at checkout, apply to the payment. Prices are shown in US dollars; taxes may be added at checkout depending on where you live.

4. License keys

Your Gutter Pro key is for your own server. Please don't share, publish or resell it. We may deactivate a key that has been refunded, charged back, bought fraudulently or shared publicly. A key doesn't expire and works without an internet connection once it's entered.

5. Updates and support

We may release updates that add, change or remove features. We offer help by email at support@zombiex5000.com on a best-effort basis.

6. Other services Gutter can use

Some optional features use services run by other companies, such as Comic Vine, Wikipedia, MangaDex, AniList, MangaUpdates and MangaBaka (for covers and summaries), DuckDNS (for an address for remote access) and Let's Encrypt (for HTTPS certificates). They're only contacted when you use those features, and their own terms apply. We're not affiliated with or endorsed by them, and they may change or stop their services at any time.

7. Remote access and security

Remote access makes your Gutter server reachable from the internet. You're responsible for your network, your router and choosing strong passwords for your Gutter accounts. Turn remote access off if you don't need it.

8. No warranty

Gutter is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the extent the law allows. Keep backups of anything important.

9. Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for loss of data, profits or files, arising from using Gutter. Our total liability for any claim is limited to the amount you paid us for Gutter Pro. Nothing in these terms limits rights you have under consumer law that can't be limited.

10. Ending these terms

You can stop using Gutter at any time by uninstalling it. If you break these terms we may deactivate your Gutter Pro key.

11. Changes

We may update these terms. The date at the top shows the latest version; changes apply from then on.

12. Governing law

These terms are governed by the laws of the State of Texas, United States, except where the law of the country you live in gives you rights that can't be changed by agreement.
